I realize that this activity involves risk of personal injury, serious disabling injuries, and, in extreme situations, the possibility of death. I also recognize that it is not possible for Phoenix Fitness to specifically list each and every individual injury risk.
However, knowing the material risks and appreciating, knowing and reasonable anticipating that injuries, disabilities are a possibility in any exercise, fitness, weight loss or training program, I hereby expressly assume all risks, known or unknown, all possible risk of injury, and disability which could occur by reason of my participation in any program or class conducted by Phoenix Fitness or otherwise inherent in exercise, fitness, weight loss or training programs generally.
I have had an opportunity to have consulted my physician and/or dietitian before starting any exercise, fitness, weight loss or personal training program with Phoenix Fitness. I subjectively understand the risks involved in my participation in this activity and knowing and appreciating these risks I voluntarily choose to participate, assuming all the risks of injury, and disability to my participation.
I further understand that Phoenix Fitness has made no representations, warranties or promises about the results I will obtain as a result of participating in any of her programs or classes, and has clearly explained to me that there can be no guarantee that I will reach my stated goals or achieve the results I desire by participating in any of her programs or classes.
By participating I irrevocably and unconditionally, knowingly and voluntarily agrees to RELEASE AND FOREVER DISCHARGE each of Phoenix Fitness, its members, principals, officers, directors, shareholders, employees and agents of and from any and all manner of action or actions, cause or causes of action, in law or in equity, suits, debts, liens, contracts, agreements, promises, liabilities, claims, demands, damages, losses or expenses, of any kind nature whatsoever, known or unknown, fixed or contingent, which the undersigned has, or may hereafter have, against any or all of them, individually or collectively.
I hereby further irrevocably and unconditionally, knowingly and voluntarily, waives any right to bring an action, claim, proceeding or suit in law or equity against Phoenix Fitness, its members, principals, employees and agents in connection with any such injury, disability, death or property damage, to the fullest extent permitted by law.
